Before we get into it, just keep in mind that when you read this rental agreement that by "TOUR DE EAST COAST INC.," "we," "us," or "our," we mean Tour De East Coast/Tourdec / Tourdec.com and our related companies that we own or control.
In consideration of your ("Renter," "You"/"you" or "Your"/"your") use of any of the Tour De East Coast Inc Services (as defined herein) provided by Tourdec.com ("Tour De East Coast," "we," "us," or "our"), Tour De East Coast Inc. requires that You (acting on behalf of all of Renter's family, heirs, agents, affiliates, representatives, successors, and assigns) agree to all of the terms and conditions contained in this TTour De East Coast Rental Agreement, Waiver of Liability, and Release ("Agreement").
The services provided byTour De East Coast include, among other things, (1) Tour De East Coast rental vehicles and equipment ("Vehicle" or "Vehicles"), and (2) all other related equipment, personnel, services, applications, websites, and information provided or made available by Tour De East Coast (collectively, the "Tour De East Coast Services"). In addition, use of Tour De East Coast Services may require use of the 'Tour De East Coast' mobile application ("Tour De East Coast/Tourdec App") provided by Tourdec, subject to its Terms of Service.
THIS AGREEMENT CONTAINS RELEASES, DISCLAIMERS, ASSUMPTION-OF-RISK PROVISIONS, AND A BINDING ARBITRATION AGREEMENT THAT MAY LIMIT YOUR LEGAL RIGHTS AND REMEDIES. FOR MORE DETAILS, PLEASE REFER TO SECTIONS 9 AND 15 BELOW.
IMPORTANT NOTICE - PLEASE READ:
You must end your rental on the Tour De East Coast App at the conclusion of the rental period. If you fail to do so, you will continue to be charged. The maximum charge for a single rental under such circumstances is $100 for 24 hours.
Upon conclusion of your rental, the Vehicle must not be parked at a prohibited parking spot, i.e. unauthorized private property, in a locked area, blocking the right of way, or in any other unapproved non-public space.
All applicable laws and regulations (including, without limitation, those applicable to traffic, pedestrians, parking, charging and Vehicles) must be obeyed, including any helmet laws in your area.
You must promptly report any damaged or malfunctioning Vehicles to Tour De East Coast via the Tour De East Coast App or e-mail Info@tourdec.com.
Unless otherwise indicated, all monetary values set forth in this Agreement shall be deemed to be denominated in Canadian dollars.
Section 1: General Rental and Use of Vehicle
1.1 Renter is Sole User
Tourdec and the Renter are the only parties to this Agreement. The Renter is the sole renter and is solely responsible for compliance with all terms and conditions contained herein. You understand that when You activate a Vehicle from the location, the Vehicle must be used only by You. You must not allow others to use a Vehicle that You have rented from the location.
1.2 Age and License Requirements
For operation of the Vehicle within Canada:
Atlantic Canada (Nova Scotia, New Brunswick, Prince Edward Island, Newfoundland and Labrador): Renter must be at least 16 years old.
Quebec: Renter must hold a valid driver's license or be at least 18 years old.
Ontario: Renter must be at least 16 years old.
Western Canada (Alberta, Saskatchewan, Manitoba, British Columbia): Renter must be at least 16 years old, except in Calgary where renter must be at least 18 years old.
Renter represents and certifies that they meet the applicable age and/or license requirements for their jurisdiction.
1.3 Renter is a Competent Vehicle Operator
Renter represents and certifies that he/she is familiar with the operation of Vehicles, is reasonably competent and physically fit to operate the Vehicle and has reviewed the safety materials provided in the Tour De East Coast App and/or Tour De East Coast's website. By choosing to use a Vehicle, Renter assumes all responsibilities and risks for any injuries or medical conditions. You are responsible for determining whether conditions, including, without limitation, rain, fog, snow, hail, ice, heat or electrical storms, make it dangerous to operate a Vehicle.
1.4 Vehicle is the Exclusive Property of Tour De East Coast
Renter agrees that the Vehicle and any Tour De East Coast equipment attached thereto, at all times, remain the exclusive property of Tour De East Coast. You must not dismantle, write on, or otherwise modify, repair or deface a Vehicle, any part of a Vehicle, or other Vehicle equipment in any way. You must not use a Vehicle, or other Tour De East Coast equipment, for any advertising or other commercial purpose without the express written permission of Tour De East Coast.
1.5 Vehicle Operating Hours and Availability
Renter agrees and acknowledges that the Vehicles are not available 24 hours a day, 7 days/week, 365 days per year. Vehicle availability is never guaranteed. Tour De East Coast may require Renter to return a Vehicle at any time.
1.6 Operating Area
Renter agrees not to use, operate, and/or ride the Vehicle in any no-ride zone as designated by Tour De East Coast and further agrees not to transport the Vehicle outside of permitted service areas as defined in the Tour De East Coast App.
1.7 Compliance with Laws
Renter agrees to follow all laws pertaining to the use, operation, parking, charging, and/or operation of the Vehicle, including all federal, provincial and local laws and the rules and regulations pertaining to rental Vehicles in the area where You are operating the Vehicle, including any helmet laws. Renter also agrees to act with courtesy and respect toward others while using the Tour De East Coast Services.
1.8 Prohibited Acts
Renter agrees to the following restrictions:
a) Safety Equipment: Tourdec recommends against operation of a Vehicle while carrying or holding items that can alter balance, add extra weight, or impair safe operation. You must not place any objects on the handlebar or controls that could interfere with operation.
b) Distracted Operation: While operating a Vehicle, you must not use any cellular telephone, text messaging device, portable music player, or other device that may distract You from operating the Vehicle safely.
c) Impaired Operation: You must not operate a Vehicle while under the influence of any alcohol, drugs, medication, or other substance that may impair your ability to operate a Vehicle safely. YOU ACKNOWLEDGE THAT THE USE OF THE VEHICLES IS SUBJECT TO THE CRIMINAL CODE OF CANADA. IF YOU USE THE VEHICLES WHILE YOUR ABILITY IS IMPAIRED TO ANY DEGREE BY ALCOHOL OR A DRUG, IT IS AN OFFENCE PUNISHABLE TO THE FULL EXTENT OF CANADIAN LAW.
d) Passenger Restrictions: You must not carry a second person or child on a Vehicle unless the Vehicle is specifically designed and equipped for passenger use.
e) Locking and Security: You may only use locking mechanisms provided by Tour De East Coast. You may not add another lock to the Vehicle or lock a Vehicle other than in accordance with Tour De East Coast's instructions.
f) Parking Requirements: The Vehicle must not be parked at a prohibited parking spot. The Vehicle cannot be parked on unauthorized private property, in a locked area, blocking the right of way, or in any other unapproved non-public space. The Vehicle must be parked in a space that is visible, and in an upright position if equipped with a stand or support.
1.9 Vehicle Use Limitations
Renter agrees that he/she will not use the Vehicle for racing, off-roading, or stunt riding. Renter agrees that he/she will not operate the Vehicle in locations that are prohibited, illegal, and/or a nuisance to others. Renter agrees that he/she will not use the Vehicle for commercial hire or reward without express written permission from Tour De East Coast.
1.10 Weight and Cargo Limits
You must not exceed the maximum weight limit for the Vehicle (as specified on the Vehicle or in the Tour De East Coast App, unless otherwise indicated).
1.11 Reporting Requirements
Renter must report any accident, crash, damage, personal injury, traffic violation, or stolen or lost Vehicle to Tour De East Coast as soon as possible via the Tour De East Coast App or Info@tourdec.com. If a crash involves personal injury, property damage, or a stolen Vehicle, Renter shall file a report with the local police department within 24 hours.
1.12 Mobile Device Requirements
To activate Tour De East Coast Services with the Tour De East Coast App, you must use a smartphone compatible with the Tour De East Coast App. Certain functions require an active network connection. You are responsible for the availability and costs of your mobile data services and ensuring adequate battery capacity. Tour De East Coast is not responsible if You are unable to unlock, use or end the rental due to connectivity or device issues.
Section 2: Payment and Fees
2.1 Fees
Renter may use the Vehicle in accordance with the pricing described in the Tour De East Coast App which may include a rental start fee, fees based on distance or time, and/or a required minimum fee. Pricing is subject to change. Fees and other charges may be subject to applicable taxes, which may be charged and collected by Tour De East Coast.
2.2 Promotional Codes
Tour De East Coast may create promotional codes ("Promo Codes") for discounts or credits on Tour De East Coast Services. Promo Codes must be used lawfully, may not be duplicated or transferred, may be disabled at any time, are not valid for cash, and may expire.
2.3 Maximum Rental Time and Charges
The maximum rental time is 24 hours. The maximum day charge is $100 based on a calendar day. Rental time is calculated from unlocking until proper rental termination confirmation through the Tour De East Coast App. Vehicles not returned within 48 hours will be considered lost or stolen, and Renter may be charged up to the value of the Vehicle plus administrative fees.
2.4 Valid Payment Method
To use Tour De East Coast Services, Renter must provide a valid credit, debit card or other accepted payment method. By providing your payment method, you authorize Tour De East Coast to charge You for rentals and any other fees incurred under this Agreement.
2.5 Additional Fees
Tourdec may charge additional fees for:
Traffic tickets, impound fees, or fines (plus administrative charges)
Vehicle pick-up from unauthorized locations
Cleaning fees if Vehicle is returned in unacceptable condition
Late return fees
Section 3: Additional Terms
3.1 Safety Check
Before each use, Renter shall conduct a basic safety inspection including: wheel condition, brake operation, lights functionality if equipped, frame condition, any obvious damage, and, if applicable, battery charge level. Renter must not use the Vehicle if issues are found and must immediately report problems to Tour De East Coast.
3.2 Lost or Stolen Vehicle
A Vehicle may be deemed lost or stolen if: (a) not returned within 24 hours, (b) GPS is disabled if equipped, (c) parked inappropriately for extended periods, or (d) other circumstances suggest loss or theft. The last Renter is responsible unless circumstances suggest otherwise.
3.3 Helmets and Safety
Tour De East Coast strongly recommends that all Renters wear properly fitted helmets approved by CPSC, CSA, EN, ASTM or Snell standards where applicable. Tour De East Coast does not provide helmets and makes no warranties about helmet safety. Renter assumes all risk of not wearing protective gear.
3.4 Limitations on Service
Tour De East Coast is not a common carrier and provides Vehicles as a convenience. Alternative transportation is available. Tour De East Coast does not guarantee safe operating conditions or maintain riding routes.
Section 4: Termination
Tour De East Coast may terminate Renter's right to use services at any time without notice. Renter may terminate use but no refunds will be provided and additional fees may apply.
Section 5: Privacy and Data
Personal information is handled according toTour De East Coast's Privacy Policy located at www.tourdec.com/privacy-policy.
Section 6: Dispute Resolution
6.1 Governing Law
This Agreement is governed by the laws of Nova Scotia, Canada, excluding conflicts of law principles.
6.2 Initial Dispute Resolution
Parties shall first attempt to resolve disputes through Tour De East Coast customer support via the Tour De East Coast App or Info@tourdec.com.
6.3 Binding Arbitration
If initial resolution fails, disputes shall be resolved through binding arbitration in Halifax, Nova Scotia, in accordance with the National Arbitration Rules of the ADR Institute of Canada. The arbitrator has exclusive authority to resolve disputes related to this Agreement.
6.4 Class Action Waiver
Parties agree that disputes shall be conducted individually and not as a class action. YOU AND TOUR DE EAST COAST AGREE THAT EACH MAY BRING CLAIMS ONLY IN INDIVIDUAL CAPACITY.
6.5 Opt-Out Right
You may opt-out of arbitration provisions by sending written notice to Tour De East Coast at [address] within 30 days of your first use of the service.

Section 8: Miscellaneous Provisions
8.1 Agreement Modifications
Tour De East Coast may modify this Agreement at any time. Continued use after modifications constitutes acceptance of changes.
8.2 Severability
If any provision is found invalid, the remainder of the Agreement remains in effect.
8.3 Complete Agreement
This Agreement constitutes the complete agreement between parties regarding use of Tour De East Coast Services.
Section 9: RELEASES, DISCLAIMERS, AND ASSUMPTION OF RISK
PLEASE READ THIS SECTION CAREFULLY – IT SIGNIFICANTLY AFFECTS YOUR LEGAL RIGHTS.
In exchange for being allowed to use Tour De East Coast Services, Renter agrees to fully release, indemnify, and hold harmless Tour De East Coast and all related parties (collectively, "Released Persons") from liability for all claims arising from Renter's use of Tour De East CoastServices, except for gross negligence or willful misconduct by Released Persons.
9.1 Assumption of Risk
Renter acknowledges and assumes all risks associated with vehicle use, including but not limited to:
Traffic and road hazards
Weather conditions
Malfunction or battery failure (if applicable)
Theft or vandalism
Personal injury or property damage
Interactions with pedestrians, vehicles, and other road or path users
9.2 Waiver of Claims
Renter waives all claims for injuries, damages, losses, or expenses arising from use of Tour De East Coast Services, whether caused by negligence of Released Persons or otherwise, except for gross negligence or willful misconduct.
9.3 Indemnification
Renter agrees to indemnify and hold harmless Released Persons from all claims, damages, costs, and expenses (including legal fees) arising from Renter's use of Tour De East Coast Services or breach of this Agreement.
9.4 Insurance Disclaimer
YOUR PERSONAL INSURANCE POLICIES MAY NOT PROVIDE COVERAGE FOR ACCIDENTS INVOLVING TOUR DE EAST COAST VEHICLES. TO DETERMINE COVERAGE, CONTACT YOUR INSURANCE PROVIDER.
Section 10: Acknowledgment
By using Tour De East Coast Services, Renter acknowledges that:
Renter has read and understood this Agreement
Renter voluntarily agrees to all terms and conditions
Renter understands the legal consequences of this Agreement
This Agreement is binding on Renter's heirs, successors, and assigns
